New Supreme Court ruling TODAY regarding employment ... On March 3rd, the U.S. Supreme Court issued its ruling in Kansas v. Garcia. The case dealt with a situation where three unauthorized aliens had used the Social Security Number of other people in completing employment verification forms, specifically including the I-9 work authorization form. The issue was whether the State of Kansas could prosecute the individuals for identify theft, as the law that requires the complet...ion of the I-9 form, which is known as the Immigration Reform and Control Act of 1986 (IRCA), places limits on enforcement procedures. In fact, one section of IRCA specifically says the I-9 forms may only be used for enforcement of the Immigration and Nationality Act. Under provisions relating to federal pre-emption, there also are restrictions on when a situation is to be handled by the federal government or a state government. A divided U.S. Supreme Court concluded it was permissible for Kansas to pursue state law criminal charges on the basis of identity theft, determining this was not an impermissible use of the information gathered from the I-9 form. So, what will happen next? Will more states pursue prosecution of unauthorized workers who commit identity theft?
