It is with great sadness that we learned of the passing of our former Of Counsel, Mr. Avary M. Dimmock, Jr. Avary was associated with our firm for many years. He was a mentor to a number of our lawyers. Not only was Avary a great lawyer, an icon in the community, he was our friend. Our thoughts and prayers are with his family.

We would like to close out the month of August by saying we are so grateful that not only were we able to finalize one adoption, but two! We cannot express enough how rewarding that area of our practice is and how appreciative we are to help facilitate families wanting to adopt.

Clark and Clark is proud to announce that our associate, Mary Beth Priest, has been appointed by Governor Deal to fill the judicial vacancy here in the Appalachian Circuit. Mary Beth has been an associate at Clark and Clark since 2010 and has been an asset to our firm and our clients. Though she will be missed, we very much look forward to her service on the bench and wish her the best of luck.
Our hearts are heavy this morning as we learn of the passing of a local attorney. Our thoughts and prayers are with the Galligan family.
The Appalachian Judicial Circuit has recently seen big changes, with the retirement of Honorable Judge Roger Bradley and the appointment of Honorable Judge Amanda Mercier to the Court of Appeals. Though their absence is certainly a loss to the circuit, we wish them well in all of their future endeavors. It has been an honor and privilege to practice with them both.
It is National Adoption Day! Here at Clark & Clark, we believe adoption is a wonderful thing and are proud of every one that we have had the privilege of participating in.

We are happy to announce that after a week-long jury trial last week in Gilmer County, that our clients were successful in reclaiming their property and recouping their attorney’s fees and expenses in a property dispute case that has been ongoing for several years. Our clients were happy, too, judging by the flowers they delivered to their attorney, Mary Beth Priest, this morning. We love to see our clients get good results at trial!
Shortly before Christmas, we were able to finalize a relative adoption. We are so pleased that this family is now complete. They have had many ups and downs and so deserve the joy that their adoption day brought and we wish them a lifetime of happiness. The boys loved having their picture made with Superior Court Judge Roger Bradley.

We are particularly grateful for the opportunity to have recently been able to facilitate another adoption. This month we finalized a stepparent adoption for a nice, young couple in Fannin County, Georgia. We had a bit of luck with the biological (and legal) father not only si...gning surrenders, as he was located in another state, but also helping to complete the medical background information for the child. For an adopted child, this information could prove beneficial later in life. We feel certain that this family will have a lot to be thankful for this Thanksgiving holiday and we are truly thankful that they chose our firm to help them through this process. We are also very happy that this adoption was a referral from a previous client, for whom we handled an adoption as well. Happy Thanksgiving and have a great holiday week. Our office will be closed on Thursday and Friday in observance of the holiday.
From all of us at Clark & Clark, we would like to remember the service of our veterans today. Many of you know that one of our own, Herman Clark, is a veteran. Herman's military service spans nearly 30 years, where he retired as a Lt. Colonel in the Air Force Reserve and Air National Guard. His military education included the areas of governmental contract law and military justice, Air Command and Staff College, and Air War College. Herman also enjoys helping each year with the Gilmer County Veteran's Day Parade. To the men, women and families who serve, thank you for the sacrifice; for protecting our families. We honor your service on Veterans Day.
September is shaping up to be a busy month for our personal injury clients, with two cases already being successfully negotiated to a conclusion. In one case, we represent a young man who was hit by an individual driving under the influence. Our client’s injuries prevented him from being able to work for several months because his job was very physically demanding. We were able to negotiate a settlement for him from the at-fault driver’s insurance company in addition to hi...s own underinsured motorist policy. Additionally, we have resolved another personal injury case in which a minor was involved in an accident where it is alleged that the driver of the vehicle was distracted by his cell phone. What is distracted driving? Distracted driving includes texting, using a cell phone or smartphone, eating and drinking, talking to passengers, grooming, reading, using a GPS, watching a video, or adjusting a radio/CD/MP3 player. The Highway Traffic Safety Administration estimates that at any given moment in America, approximately 660,000 drivers are using cell phones or electronic devices while driving. Using handheld phones and other portable devices increases the risk of getting into an accident by three times. We are happy to announce that last month we finalized two adoptions. Coincidentally, there were similarities between them. Both were stepparent adoptions where the biological fathers were contacted to execute surrenders but refused to do so for various reasons. We had to make multiple attempts to track down and serve these biological fathers. The biological fathers’ rights were then ultimately terminated at court and both clients were able to successfully adopt their respective child. Adoptions are such a rewarding part of our practice. It is always such a pleasure to witness, along with our client and their family, the Final Judgment and Decree of Adoption being signed by the Judge.
We are pleased to report a successful outcome for our client in court this week. Our client, a young father, petitioned the court for custody of his two year old child. After two contested hearings, the court has ruled in favor of our client, granting him permanent custody of his child. As an attorney, it is rewarding when your client cries tears of happiness and relief at the end of a court battle. Our client and his family look forward to making many memories with the child in the future.
September and October have been good months for personal injury clients. We have successfully negotiated and settled six cases, compensating our clients for the medical expenses and pain they experienced as a result of accidents that were not their fault. Each personal injury case is different and highly dependent on the client’s injuries, medical expenses, insurance availability and other factors. We do not recommend settling your case unless the settlement offer makes sense in light of what you have gone through, and for these clients it did. Clark & Clark has had the pleasure of representing a wife who filed for divorce from her husband after a twenty plus year relationship. After three years of litigating and stalled settlement negotiations, on the second day of jury trial our client was made an offer that will allow her to live comfortably and not be forced to find a full-time job at age 68, after having left the work force 15 years ago. Despite so much acrimony over the past few years, the clients were talking and exchanging pictures of the grandchildren as we were drafting up the settlement documents. That may be the hallmark of a good, fair outcome for both sides.
All adoptions are special to us here at Clark and Clark. Recently we had the pleasure of facilitating a stepparent adoption in which it was expressed to us by our clients that it was the child’s hope to get to start the new school year with a new last name. Not having the luxury of a great deal of time, we, with the help of the Judge’s Office and the Gilmer County Clerk of Superior Court’s Office, were able to finalize the adoption a few days before the start of the school year. It was the quickest adoption from start to finish that we have ever assisted. What a joy and privilege it was to see how happy our clients were, and especially how happy the child was.
Clark & Clark has had much success with the appellate courts in 2013. We recently received a decision from the Court of Appeals in favor of our clients. Our clients were sued by someone claiming to be majority shareholder of a corporation, in an attempt to control corporate assets and property. Our clients’ position was that the person was not the majority shareholder because a number of stock transfers to him were done without proper notice and approval. The Court of Appeals agreed with us and declared our clients to be the majority shareholders. Our clients, who have felt bullied for years, now feel vindicated and proud that they took a stand. We are very happy that we were able to help them get the result they wanted.
After five long years of litigation on claims against her family land by her neighbors, which included a week-long jury trial and numerous appeals, our client finally got the news she has been praying and hoping for from the Georgia Supreme Court yesterday. The jury’s verdict, which was rendered in March of last year, granted her quiet title to her family land in Fannin County and also recouped for her $48,000.00 spent in attorney’s fees and expenses. The Supreme Court unanimously affirmed the judgment in June, and yesterday, the Supreme Court unanimously refused to reconsider their decision. Thus concluding the case and giving her closure on claims against her land once and for all for her. We are so proud to have helped her throughout this painful ordeal that now ends happily for her and her family.

We have a happy client this morning. We were able to procure a $24,000 after he was bitten on the leg by a dog. He had $2,800 in medical expenses and suffered no permanent injury or visible scarring.
