The win streak keeps going! Yesterday, at about 4:30, jury came back with a not guilty on all counts verdict! My client was facing charges of 1) possession of marijuana with intent to distribute (Felony), 2) possession of marijuana > 1oz (Felony), and 3) open container (Misdemeanor). The jury made the right decision. There was about a pound of marijuana found in a car he was allegedly driving. Witnesses included 2 officers and 2 codefendants who turned State. After my cross ...of the first officer, who was the first witness, I knew we had reasonable doubt and likely a not guilty verdict. This only grew stronger with each witness. Jury trials always remind me of the beauty of our Constitution.

On a roll lately. Last Thursday, got all charges dismissed at the preliminary hearing for a 17 year old facing some very very very serious charges. Client was facing charges of: Trafficking Meth, Trafficking Heroin, Trafficking Marijuana, and Possession of a Firearm During Commission of a Felony. I read the investigative report, and this case pissed me off. I got really fired up about this one. After reviewing the scant documents I was provided, It was clear that my client an...d his codefendant were not involved in this, they were truly at the wrong place at the wrong time. Me and the codefendant's attorney went through with the prelim, and the detective was being very evasive on the stand and refusing to answer certain simple questions (for a while, then he finally spit out the truth). The Judge ended up not finding probable cause to bind the case over to Superior Court, and the charges were dismissed. Walking out in to the hall afterwards and talking to the family reminds me of why I keep fighting the State. There were grandmothers and mother weeping with joy in the hallway. Another happy reminder that all of my hard work is paying off!
