I am starting a weekly blog via posts on this page it will address a lot of issues. This week issue is DUI checkpoints. Police have the right to set up checkpoints according to the US Supreme Court. However, most checkpoints are illegally operated. Therefore, if you find yourself approaching a check point remember these things. #1 The purpose of the DUI checkpoint is for them to obtain probable cause to detain you for a DUI. Probable cause can be determined by smell of liquo...r, blood shot eyes, slurred speech and etc. They attempt to gain probable cause by asking for your license and other questions to smell your breathe or observed your movements. #2 You can present your license without saying anything or without rolling your window all the way down to communicate. I would recommend slightly cracking your window to slide you license through it and to keep all communication at a minimum. #3 Finally all checkpoints must be placed at a point where the citizen has the right to avoid the checkpoint all together. I ENCOURAGE ALL OF YOU TO PLEASE DON'T DRINK AND DRIVE. If you find yourself in a DUI checkpoint just remember the three points I mention above. If you are arrested remember: Relax Get Alex! If you elect to drive during this time and is involved in an accident most insurance policies will not cover you. So please stay off the roads until this storm has passed unless its an emergency.
