Over the summer, my wife warned me that police in Columbus were cracking down on "distracted driving," even going so far as to set up sting operations with officers posing as construction workers in an attempt to catch people using their phones while behind the wheel. That seemed a bit aggressive, but texting and driving is a huge problem, so I kept my mind open. Then, in early September, I was sitting at a traffic light when a motorcycle officer pulled up beside me. I was... in the process of returning a telephone call. The officer sternly ordered me to put away my phone. I responded by letting the officer know that OCGA 40-6-241 allows use of the telephone function on one's phone, even while operating an automobile. The officer told me to pull over, and he gave me a citation for distracted driving. I showed up in court to fight the citation. The officer professed not to know that using the telephone function was legal until I read him the statute in the courtroom. The officer admitted that he had no idea if I was using the telephone function. Ultmately, the ticket was dismissed. I offer this real-life experience to let folks know that they should be aware of their rights. DO NOT TEXT and DRIVE. Don't email or be on social media and drive. Try to minimize even lawful telephone use. But remember that Georgia law in fact allows the use of a telephone.

Our partner and dear friend, Peter John Daughtery, died on Sunday, October 29, 2017. He was 53. He leaves behind his wife, Julie, and daughter, Meg, as well as an extended family and countless friends. Peter John was named appropriately. Peter means rock. It was the name Jesus bestowed on the disciple upon whom the church would be built. Pete Daughtery was a rock -- for this law firm, for the community, but most of all, for his family. John was the beloved disciple, and... Peter John was well and truly loved, again, by everyone who got to know him. At our firm that lists Pete's name first, Pete was our rock and was truly loved. Yes, he was a truly special lawyer. Yes, he was also a dear friend. Yes, he was an unmatched husband and father. But he was an extraordinary human being. At Daughtery, Crawford & Brown, Pete will be sorely missed. We love you, dear friend, and we hope to meet you again one day.
