Department of State issues announcement regarding issuance of work visas. DOS announced that as a result of the federal district court's injunction in National Association of Manufacturers v. DHS, any J-1, H-1B, H-2B, or L-1 applicant who is either sponsored (as an exchange visitor) by, petitioned by, or whose petitioner is a member of, one of the plaintiffs in the lawsuit is no longer subject to PP 10052’s entry restrictions. The named plaintiffs include: the National Association of Manufacturers, the U.S. Chamber of Commerce, the National Retail Federation, TechNet, and Intrax, Inc. UPDATES ON FORM I-944 (Self Sufficiency) FROM USCIS If you filed your Form I-485, Application to Register Permanent Residence or Adjust Status, after Feb. 24, 2020, you will need to file Form I-944, Declaration of Self-Sufficiency. If USCIS receives Form I-485 before Oct. 13, 2020, that does not have all required forms and evidence, the Agency announced that they will request any missing forms and evidence. After Oct. 13, 2020, they will reject your Form I-485 if you do not include the required forms and evidence with Form I-485 at the time of filing.

Typically you cannot provide evidence of work authorization until you have your card in-hand, even with your approval notice. However, USCIS recently recognized the significant delay in issuing these cards. As a result, employees may use Form I-797, Notice of Action, with a Notice date on or after December 1, 2019 through and including August 20, 2020 informing an applicant of approval of an Application for Employment Authorization (Form I-765) as a Form I-9, Employment Eligibility Verification, List C.
