Recently a wild case was closed in the Georgia Court of Appeals between Snapchat for breach of duty of care in designing the app’s speed filter. The plaintiff was trying to recover for damages due to a crash and after much back and forth, the court indicated that no special relationship existed in this case between Snapchat and the other driver, or plaintiffs. I just wanted to brag on Molly Gillis real quick. Molly and I are working as co-counsel in a car wreck case, which went to mediation this past Friday. It was Molly’s first mediation representing the plaintiff in a personal injury case and we settled a case, with $63,425.00 in medical bills, for $500,000.00. I forgot to get a picture of us Friday, so we took this one today. Molly’s fantastic evidentiary presentation made it clear to the insurance adjuster why our client deser...ved half a million dollars. The client is thrilled with the result and I can tell his fears and anxiety about the future are gone. Our mediator Tom Harper did an amazing job as usual. However, mediating with Tom for a full day can be exhausting. He spent the day relentlessly attacking me, Molly, and our client on the weaknesses in our case. I imagine the only thing more difficult is trying a case against Tom. Thankfully, I know he was working on the insurance company and opposing counsel just as hard. Free Consultation tip. The Atlanta Police Department has announced they will no longer investigate car wrecks without injuries due to Covid-19. As a result, I finally did something I’ve been meaning to do for a long time. I bought DashCams for both our vehicles. I recommend you do the same. The ones I bought were recommended as being easy to use and they were just under $100 each. I’ve seen insurance companies where everyone at the scene (including their insured) agreed the...ir driver was at fault deny liability when they didn’t think the person making the claim had enough information to prove it. I’ve even seen them deny the wreck happened because there was no police report. If you are involved in a collision in City of Atlanta or on private property (such as a parking lot) and the police refuse to send someone to create a report here is what you should do: 1. As I mentioned above, before the wreck happens consider purchasing and installing a DashCam. 2. Call 911 and tell them what happened. If you need a copy of the recording later, you can get through an open records request. 3. Take pictures and/or video of the vehicles before they are moved, all the damage, and tag number of the other vehicle(s) involved. Take pictures of anything you think might be relevant to explaining what happened later (broken glass, skid marks, etc). 4. Exchange information. When you get the name and insurance information of the other driver(s) involved take a picture of the insurance card and drivers license. 5. If the other driver is admitting fault, saying sorry, etc, consider recording your interaction. It will be difficult for them to change their story later. 6. At a minimum, get names and phone numbers of any witnesses. If the witnesses are willing, get a quick recorded statement of what happened. 7. Download and fill out the SR-13 form. I don’t know if insurance companies ever give these reports any credence, but at least it will be a record of pertinent details of the crash. 8. Promptly report the wreck to your auto insurance company. Free consultation tip. This $100,000.00 check came in today’s mail and it made me think of these two pieces of advice I thought I would share. One - Purchase a significant amount of Uninsured Motorist (UM) coverage for your vehicle. $100,000.00 or more. ... Two - Make sure it is Add On coverage, not Traditional or Default. The premium price difference is nominal, but the benefit to you and your family can be huge. Here is a brief story about one of my cases. Another driver failed to yield, and turned left in front of my client causing a significant T-bone collision. My client was hurt and required 6 months of treatment. The police report indicated the at fault driver had car insurance, but that turned out to be wrong. Geico denied coverage. Luckily, my client was driving her mom’s car and her mom had $100,000.00 in UM coverage. We proved up her case and recovered the full limits from Liberty Mutual. It was a great result and the client was thrilled. The happy ending was possible because of my client's mom's smart decision when she purchased her policy. Uninsured Motorist coverage is not required in Georgia. As a result, most people don’t carry it. It is a common mistake that can result in really tragic consequences. Even when the other driver is insured, UM coverage can be a life saver. $25,000 is all that is required in Georgia and often that is not nearly enough. Medical treatment is so much more expensive today than when the $25,000 minimum limit was established so many years ago. When the liability policy isn’t enough, UM coverage is the only way to get a fair recovery, and Add On UM coverage is the only type of UM that gives you what you paid for.
