About to watch my boy Brian Tevis verbally kick state’s butt before the Supreme Court of Georgia! For the past few weeks, I watched him prepare & over-prepare every possible scenario of hypotheticals. There are probably only a handful of attorneys who ever get to argue before the Georgia Supremes and even a smaller percentage who are as good as the folks I get to call my office cohorts. @David Wolfe

Today at 4:30pm- Prosecutor: My plea offer will expire tomorrow after our motion's hearing. Me: That's vindictive; punishing someone for exercising their Constitutional right.... Prosecutor: Um. . . ah. . . um. . . I was going to revoke tomorrow anyways; even if we didn't have the hearing. Um, it's just a coincidence that the motion is tomorrow too. . . . . . in times of LAZY & AFRAID. #intimesoftrialsandadversity.

In the last few years, I've been sensing a slow, yet steady, buildup of collective pressure in this country like I've never seen before- and its not just from the conservative but equally as much from the liberals. Each side stands on a moral high claiming that the "others" (defined as those that seemingly oppose their views) are so completely wrong that a swift/summary dismissal of their opinions is not only justified but necessary. Each side believes the "others" are inh...erently immoral simply because the "others" hold opinions they disagree with. While the Left accuses the Right of being racially intolerant, the Left are equally intolerant of any expression that may seemingly appear contrary to their position. Such deep contentions are taking the form of conflicts around topics like race, gender, political ideologies, socio-economic issues, and even the infamous ppe-mask. Behind it all, there are political/media entities that fuel such discord (obviously because its beneficial to them) by encouraging rage and blind emotional reactions in face of multiplicity of views. They've made words like "tolerance," and "compromise" into foul language. Regardless of the outcome of this election, this nation is loosing its most valuable assets- freedom of speech, diversity, and the ability to surmount biases with resourcefulness. I worry that my community of friends & family are becoming increasingly contentious, lacking in communication, and incapable of civil conversations. May we all learn to be harmonious with each other.

(Posted with permission) Alexis- a hispanic 21 yr old soccer player at Kennesaw State Univ. getting his B.A.S. in Architecture while working with his dad at at the same company. Last Thursday, as Alex was driving his family friends to a park in Acworth, a caucasian male began following his car for approximately 15min. When Alex pulled into a gas station, the man following him pulled into another lot across the road and called the police on him. The officers...arrived and spoke to the other man; as soon as Alex got back on the road, officers stoped him and arrested him for DUI. Enter: Kalpin Shah Law. Typically, we’d get Alex a bond and he’d be released by at most the next day. But instead, Alex had an ICE hold and we had to advise him not to bond out to avoid being transported to ICE custody instead. While in custody, I continuously kept warning him, NEVER SIGN ANYTHING! Instead, we bound the case from Acworth to Cobb County State court. On the first day of Alex at the Cobb jail, I discussed Alex’s case with his ICE detention officer and secured the cancelation of the ICE hold. Based on that meeting, I advise his family to pay for his bond.20mins later, Alex was released. An hour later, he treated myself and his whole family to dinner take-out but when he got the check, he looked up at me for permission. . . before signing! #InTimesOfTrialsAndAdversity.

Recently, I had an opportunity to speak with Fani T. Willis. What an absolute pleasure and a refreshingly honest down to earth conversation. Fulton residents who do not know her already- please research her as a worthy candidate for Fulton DA, please research the incumbent Paul Howard and the long list of criminal/fraudulent allegations against him (including multiple sexual harassment allegations from his subordinates), and feel free to contact me for my views as a crimin...al defense attorney who understands the dynamics of the Fulton DA’s office. Never in my career have I ever seen a DA hold a press conference as the one held for the prosecution of the two officers while 17 other cases of excessive force continue to remain longtime pending in his office with no further progress. Furthermore, consider the likelihood that even if Howard were to be re-elected, there’s a chance he may be removed due to his criminal transgressions leaving his vacancy for our highly competent Governor to fill. #ImWithFani

We’re in the midst of a political tug of war with the DA’s office and his run-off election, the community mourning for Rayshard Brooks’ death and their civil right’s attorneys, the Police Departments and the defense team for the officers. There are lawyers behind each entity. . . and the one thing I know about a good lawyer is his/her ability to tell a good story. Give the same set of facts to 5 different lawyers and you’ll end up with 10 different stories. In the midst o...f this fog of narratives, TRUTH is in short supply. There is an essential need to preserve the truthful account based on an unbiased PERSONAL KNOWLEDGE to the incident. In addition to the numerous videos, a truly credible source of the facts is my client Mack. He simply offers the TRUTH- nothing more or less. But here’s an interesting point he notes, in a recorded statement to me which unfortunately does not get covered by either of the news interviews: Mack notes the stark contrast in the demeanor of the two officers- one very empathetic while the other quite stoic. Mack has agreed to provide his recorded statements to all the interested parties. . . i.e. parties interested in the TRUTH.

Even if Brooks was carrying a taser, it can be said that he was still unarmed at the time he was shot. This is so, especially because he turned and deployed that taser. This is because, once a taser is deployed, it must be recoiled before reuse. Once deployed, it is no more than a piece of plastic until recoiled. An officer knows/should know that.

My assistant, Dexter, & I just spent the last 3hrs listening/counseling with two very brave and noble young people who eye witnessed Rayshard Brooks’ murder. At one point, I almost started crying at the disgusting inhuman & careless demeanor of the officers. (Doesn’t happen easily to me as a criminal defense attorney who deals with murders & molestations.) Regardless of how the legal analysis of a taser being a deadly force is resolved, the complete lack of empathy of th...e officers deeply stirred the non-lawyer / human being part within me. Finally, we completed a full account of what they witnessed and I was able to counsel them with regards to the next steps (pro bono of course). There are several others who have had to endure witnessing the horrific incident. I know it’s scary... it’s scary to share. It feels more comfortable to just hold it in. But as a criminal defense attorney, I see the racial injustice in our criminal justice system EVERYDAY. There’s an entire community of people that suffer this DAILY. So please... please come forward and speak up! Speak the TRUTH! That is your calling... my calling... OUR calling. Together! One! #ExhaustedButStillGoing

Yesterday, I had the privilege of representing a member of the MARTA Army (who volunteered to feed the mobility operators of MARTA furloughed due to the pandemic), he also serves as a liason on the national board of the Labor Network for Sustainability, after getting a Masters in city/regional planning from Georgia Tech. He was arrested on Monday night while he happened to be volunteering to feed the protesters. Instead of rewarding and encouraging people like my client, ...our society is built to arrest and breakdown them. Another friend of mine L.M. Harrison and her friend Asia, were also taken into custody that same night in what she called, "accidental arrests." "I’ve seen countless cases where a person is arrested, held in custody with a high/no bond all while pending meaningful investigation. And you say you moved with extraordinary speed?!? Malice murder on video from various angles- & he’s not arrested for days. If the situation had been flipped, all the other three officers and their momma’s dog had been arrested.... If the situation had been reversed, the perpetrator would be facing Malice murder with death penalty (which I’m against) or multiple life sentences. 25yrs would’ve been a plea offer. I neither condone the riots nor the police brutality. . . but I can understand the rage of the riots!" -Kalpin Shah.

Shocked at the loss of a dear friend, Raj. Our friendship started as a work colleagues - always ever helpful to go beyond the call of duty for a Staff Attorney. Naturally, we became friends and would regularly grab lunch & coffee whenever I was in Cobb usually swapping work stories, girls we were talking to, and life in general. Through all that, his purity, piousness, and overall wholesomeness was clearly apparent. His untimely murder makes his loss even more shocking (I ...mean I just spoke to him recently about how he was driving meals for people during this pandemic & even in that, he was telling me how the restaurant had messed up an order so he personally/selflessly drove back to fix it) but I feel such pride in his selfless act to protect a complete stranger- that's completely inline with his character!
