Happy Tuesday!!! Weekly Virtual Appearances is now a standard practice in my new normal. I haven’t been in Court physically since the week of the shutdown. However, I continue to have virtual appearances every week. Here are a few tips that I’ve learned over the last 4 months.... 1. Great lighting is important as poor lighting may be distracting if it’s too dim. 2. Client preparation is key. I always try to make my clients comfortable by providing anticipated expectations on how the process will go. I now offer a Zoom Practice Meeting before the scheduled appearance for clients that may have never used Zoom before. 3. If it’s a hearing or bench trial, prepare your documents in advance and study the notice as it may require that exhibits be sent well before the scheduled appearance. This is also true in a deposition. 4. Visuals are beneficial when appropriate. For example, in my mediation this morning, I played a video of the entire incident during my opening statement. 5. Protect attorney-client communications. Most appearances are in open forums. Also, in some cases, like mediations, you have breakout sessions where the attorney and client are alone, but it may be recorded (deposition) or the neutral may pop in at any moment. I suggest having a separate means (like a phone) to communicate via text or by call. Remember to hit mute on Zoom, if this is the case. 6. I like to send the Zoom links to my clients via text message. It makes it easier to access. 7. Last, I use two laptops. One for the appearance, with only documents open that I plan to share. The other laptop is used to access all other information. You give the Zoom program access to your device during the session, so I think it’s prudent to only have open relevant documents just in case...this also protects anything that is privileged.
