If you are stopped by the police while driving, is it ever a good idea to run from law enforcement? The answer is simply, NO, and the consequences of doing so are very serious in Georgia. Georgia makes it a felony with a two year minimum sentence for fleeing and eluding (O.C.G.A. 40-6-395(b)(5)(A)). The new hands free law in Georgia has been in effect since July 1st. Since then, police in Georgia have issued thousands of citations. Drivers are now forbidden from having a phone in their hands or touching their body while driving; that means no texting, emailing, browsing social media, or talking on the phone while driving unless the phone is in hands-free mode. There is no age distinction and this law affects every driver in Georgia. For better or for worse, teen drivers ...are no longer forbidden from using electronic devices while driving, as long as they obey the hands free law.
