Whitney Judson argued and won a Motion to Dismiss on behalf of a defendant motorist in plaintiff-friendly Augusta, Georgia. While the plaintiff argued that Georgia’s Crime Victims Restitution Act tolled the statute of limitations, Whitney argued that this exception, tolling the statute, was inapplicable in this case. The judge agreed with Whitney’s arguments and issued a ruling from the bench, dismissing the plaintiff’s case.

The Georgia Court of Appeals recently affirmed the dismissal of an Athens infectious disease doctor and nurse practitioner represented by Dan McGrew and Colleen Callaghan on appeal. In the underlying case, plaintiff alleged that the true nature of her post-procedure complications were not fully disclosed to her causing sepsis and renal failure. Plaintiff alleged both professional and ordinary negligence as well as fraud. The trial court dismissed plaintiff’s case for failure ...to state a claim and for insufficient expert evidence to support the professional negligence claim. Plaintiff appealed. On appeal, Dan and Colleen prevailed on behalf of the defendant healthcare providers. U.S. Eleventh Circuit Court of Appeals Affirms U.S. Southern District Court’s Grant of Summary Judgment in Correctional Medicine Case. Spencer Bomar and Sam Britt represented a physician who was alleged to have been deliberately indifferent to a prisoner’s serious medical need in violation of the prisoner’s constitutional rights. The prisoner alleged that the physician failed to timely evaluate and treat the prisoner’s fractured knee, which caused him to sustain additional i...njury, pain, and suffering. On behalf of the physician, Bomar and Britt vigorously defended against these allegations, asserting that all care provided complied with and exceeded the applicable standard of care. Bomar and Britt filed a Motion for Summary Judgment in the Southern District of Georgia, showing that Plaintiff’s claims fail as a matter of law. The Southern District of Georgia agreed, and granted the Motion for Summary Judgment. The plaintiff appealed the decision to the Eleventh Circuit Court of Appeals. In a lengthy and detailed opinion, the Eleventh Circuit Court of Appeals affirmed the decision of the Southern District of Georgia to grant the physician’s Motion for Summary Judgment. In doing so, the Eleventh Circuit Court of Appeals adopted and agreed with the arguments advanced by Bomar and Britt, finding that the evidence showed that the physician acted quickly, appropriately, and in compliance with the standard of care such that he could not have been deliberately indifferent as a matter of law. https://mmbblaw.com/results-matter/
