Our Carrollton office has relocated to 120 Dixie Street! We are excited about the opportunity to continue to grow and serve our friends and clients in the Carrollton community, and to continue a long-standing tradition of law practice in this special place.

MPP's Covid-19 Closing Procedures: McMahan Perry & Phillips is dedicated to serving our clients' real estate closing needs while actively participating in government initiatives to avoid the spread of Covid-19. We have designed several choices for closing protocol which will accomplish both of these goals. We will now offer each party to a closing their choice of one of the following closing protection levels: Level 1 - Outdoor Closing - (our primary and preferred closing m...ethod) this will be an outdoor closing, with the parties signing at different times, and only essential parties present, with social distancing requirements in place Level 2 - Drive Thru Closing - this will be a closing where we will allow the party to sign the closing documents inside their car, but we will have to take special measures to view them signing their documents, either by standing 6 feet away, or by initiating a zoom call to allow the witness and notary to view the signing. Once the closing is concluded, we will deliver all final documents, checks etc, back to the party through their car window. Level 3 - Delivery Closing - this should be reserved for clients with special medical considerations. This will be no further than 10 miles from one of our two office locations, and will cost an additional $250.00. This will be a closing where we deliver the closing documents to the client's location, initiate a zoom call to view signing and answer any questions, and then retrieve the package after signing. We will then finalize the file at our office and deliver all copies and funds by either mail, email or wire. Once a party makes an election as to which level closing they prefer, the closing secretary will send specific instructions on how the closing will be coordinated at the time the ALTA statements are sent out. Agents, please make sure your clients are aware that there are or can be delays in banking and the sending of wires. If they will be sending money for closing, they should check with their banking institution in advance and inquire about time frame and procedures for getting the wire to the closing attorney on time. If you need to know how much to wire due to banking procedures prior to receiving your ALTA statements, just contact the closing secretary for an estimate.

Governor's Executive Order regarding real estate: The Governor has signed an order that allows closing attorneys to watch parties sign their documents both in person and over a video conference. Regardless of how we watch them sign, we still have to have original, blue ink, "wet" physical signatures on closing packages, per State and Federal law. The order only excuses us from seeing the signature in person - we may now see it over video. Once the party signs the documents... we still then have to sign them as a witness or a notary, and all other aspects of the closing documents and signing requirements remain the same. We are getting a lot of agents who now believe that we can do complete e-closings with e-signatures like on dot loop etc., and this is not the case. If you have any questions after you have read the Governor's Executive Order concerning real estate transactions and witnessing/notarizing of signatures in relation thereto, please contact your closer at our office and we will be happy to go over it with you or your client, as needed.
