Please check out the National Association of Premises Liability Attorneys (NAPLA). It appears to be the first and only national organization for trial attorneys who represent plaintiffs in all different types of premises liability cases. NAPLA was founded with three goals: 1) to educate attorneys who have expressed a desire to better represent people who have been injured or killed on the premises of another person or business; 2) to build community and provide networking ...opportunities for these attorneys; and 3) to promote public safety by encouraging businesses and insurers to put safety first. In support of that mission, NAPLA will be doing regular educational webinars for its members on all facets of premises liability cases, and we hope to have our first national conference next year. NAPLA was not created to lobby or to supplant important local or national organizations like GTLA and AAJ. Those organizations are vital and worthy of our support. NAPLA’s primary goal is to help lawyers better litigate their premises cases. In moving the organization forward, we are excited to be supported by an Advisory Board of luminaries in premises liability cases, including Robert Bohm, Saul Gruber, Mark Kosieradzki, John Leighton, and Phillip Miller. This week the Ninth Circuit Court of Appeals reversed the District Court’s dismissal of the wrongful death lawsuit our law firm filed against Snapchat. Neff Injury Law, along with Bondurant, Mixson and Elmore, filed suit against Snapchat on behalf of the surviving parents of two boys who were killed in a high speed crash in Wisconsin. The Complaint alleged that Snapchat had encouraged the boys to drive at dangerous speeds and caused the boys’ death by the negligent design of... its Speed Filter. The Speed Filter posts the speed a Snapchat user onto a Snap which can be a photo or video. This can be then be shared on the social media app. Snapchat argued that the Communications Decency Act (CDA) immunized the social media company from the Plaintiff’s claims. The Ninth Circuit disagreed and found that Snap is being sued for the predictable consequences of designing Snapchat in such a way that [] allegedly encourages dangerous behavior. The CDA does not shield Snap from liability for such claims. Unfortunately, this is frequently a significant issue in representing people that have personal injury claims - particularly when there are low insurance limits for a car wreck (like 25,000 minimum in Georgia) and very high medical bills. A scary thought - a study done by the University of Central Arkansas determined that if a more comprehensive hair analysis were done rather than urine testing, it would reveal that 300,000 tractor trailer drivers should be fired.
