Divorce is hard enough emotionally. If you and your spouse agree on the terms of the divorce, the process doesn't have to be difficult. An uncontested divorce is a faster and lower cost option for a couple that both agree on the terms of the divorce. To setup a consultation appointment, call O'Quinn Law Firm, LLC at 678-572-4775.

O'Quinn Law Firm, LLC encourages everyone to review their Wills and supporting documents every 3-5 years to ensure that the documents accurately reflect your current circumstances. A habit of regularly reviewing your Will, Advance Directive for Health Care, and Financial Power of Attorney will help you identify when the documents have become out of date due to life changes (i.e. the birth of a child, death of a health care agent or beneficiary, or other changes impacting yo...ur documents). If you find that everything is current and correct, then no further action is needed. HOWEVER, if you find that your Will, Advance Directive for Health Care, or Financial Power of Attorney are out-of-date, or need to be established, call O'Quinn Law Firm, LLC at 678-572-4775 for an appointment to discuss your needs.
At the beginning of each New Year, we all have the tendency to look back and assess the prior year; we also make plans for the coming year based on those assessments. As you move forward with your New Year plans, O’Quinn Law Firm, LLC is here for your family law and estate planning needs.

When you are determining where you will store your Will, you should consider the following: If you store your Will in a safe deposit box and you don't have another person on the safe deposit box with you, or if the other person dies or becomes incapacitated before you pass, then according to Georgia law, the person looking for your Will must petition the Probate Court for the bank to look in the safe deposit box for your Will and the bank must return the Will to the Probate Court. The petitioner is allowed to receive burial instructions and/or a burial plot deed from the Will and/or contents of the safe deposit box. This can add time before your burial instructions are found, unless you have disclosed your burial instructions separately.
My goal as an Estate Planning Attorney in Georgia is to help my clients understand how different assets will transfer upon death. Specifically, retirement plans and insurance policies will disperse to the listed beneficiaries without having to go through the Probate process; however, if no beneficiary is listed that dispersement must go through the Probate process before it makes its way to the heirs of your estate or beneficiaries of your Will. I strongly encourage clients to confirm who the listed beneficiaries are, and whether the policy or plan will permit back-up beneficiaries.
