Legal Fact of the Day (Contracts!): On this day in 1920, a legal contract was made between the Boston Red Sox, New York Yankees, and Babe Ruth. The Yankees would give the Red Sox $125,000 in cash and about $300,000 in loans, in exchange for getting Babe Ruth! At the time, Babe Ruth was making $10,000 a month, which was quickly increased by the Yankees, along with a fresh new contract. The Yankees went on to win 39 AL pennants and 26 World Series titles, while the Red Sox w...ent 86 years without a title. And here's a quick legal lesson without spending 100K for law school: Every contract needs 3 things: (1)Offer, (2)Acceptance, (Consideration--like money). #contract #baseball #mlb #lawstudent #law

Legal Fact of the Day (Starting 2021 off with some Women's History!): On this day in 2007, Nancy Pelosi became the first-ever woman Speaker of the House of Representatives! How do you become the Speaker of the U.S. House of Representatives? You are elected by the majority party--in this case, the Democrats.... What do you do as the Speaker? You preside over Presidential Impeachments! And, of course, you do the regular boring things like appoint people to committees and make the legislative agenda. The Speaker is also second in line of presidential succession (right after the vice-president). You can read more about that on my blog at: www.AJRichman.com #law #congress #USA #Constitution

Legal Fact of the Day: On this day in 1982, the first execution by lethal injection took place in Texas. The first drug, sodium thiopental, a barbiturate, renders the prisoner unconscious, the next, pancuronium bromide, a muscle relaxant, paralyzes the diaphragm and lungs, and the third, potassium chloride, causes cardiac arrest and ensures the prisoner’s death. Brooks and two friends used heroin, drank, then decided to go shoplifting. When their car broke down, Brooks wen...t to a nearby auto dealership and asked to test drive a car. An employee of the dealership, David Gregory, a 26-year-old mechanic was required to go with Brooks pursuant to company policy. Once inside, Brooks kidnapped Gregory and went to a hotel, where he and friends bound him and shot him to death. His final meal was a T-bone steak, french fries, ketchup, Worcestershire sauce, biscuits, peach cobbler, and iced tea. Almost five years after Brooks was convicted, Woody Lourdes, who had been indicted for and convicted of the same offense, and whose murder conviction had been REVERSED on appeal, made a plea bargain with the State, pleaded guilty to non-capital murder and was sentenced to forty years in prison!! #crime #deathpenalty #law

Legal Fact of the Day: On this day in 1997, NBA star Latrell Sprewell was suspended for 1 year for attacking Golden State Warriors Coach Carlesimo. The Coach told Spreewell to "put a little mustard" on a pass. Sprewell grabbed him by the neck and choked him. When told to leave, Sprewell punched the Coach. After an appeal, Sprewell's suspension was reduced to 68 games, which equaled about 6 million bucks.

Legal Fact of the Day: On this day in 1956, the US Supreme Court overturned Plessy v. Ferguson (been around since 1896) and struck down an Alabama law requiring racial segregation on buses and other forms of transportation. The case name is Browder v. Gayle. Ya'll might be more familiar with it as the Rosa Parks case. Interestingly, Rosa Parks was not included in the lawsuit because she had a pending criminal case on appeal. The civil rights attorney felt that adding her name to the lawsuit might circumvent her appeals that were already running through the court system. #RosaParks #Outkast #law #crime #lawstudent #civilrights

Legal fact of the day: On this day in 1919, Congress passed, over the President's veto, the Volstead Act which enforced the 18th Amendment and enforced the prohibition of alcohol! FDR changed this later on and the Twenty-First Amendment gave prohibition power to the States. Americans linked alcohol to immorality, criminality, and unpatriotic citizenship (mainly, people were getting too drunk to serve in the war or live productive lives). This is one of the few Amendments that as passed OVER the President's veto power (then-President Woodrow Wilson). It's called the "Volstead Act" after Andrew Volstead who was chairman of the House Judiciary Committee (today, that would be Chairman Jarrold Nadler).

Legal fact of the day: On this day in 2001, President Bush signed into law the USA Patriot Act. The Act allowed among other things the use of wiretaps, enhanced penalties for terrorism, allowed the use of new technology, allowed Federal judges to issue subpoenas secretly. Some argue this "mass surveillance" violates your Fourth Amendment and privacy laws. Others argue the benefit of catching terrorists outweighs privacy concerns. What do you think is more important--the Government being able to listen to your conversation in order to catch criminals and terrorists, or you being able to talk on the phone without the Government listening?
