The court relies on the best interest of the child standard when determining custody and parenting time. There are a number of factors taken into account when determining custody. Generally, children are not brought into court to testify or speak to the judge. A child who is 14 years old or older may complete an Affidavit of Election informing the court that they would like to live with a particular parent and absent a showing that it is not in the child’s best interest the c...ourt shall allow the child to live with the parent of her choosing.
