For estate planning purposes, this is the way that land title law works. If 2 people are named in a deed as the owners, they are called tenants in common. When the 1st owner to die passes away, that owner's share is part of his or her estate. So generally the survivor owns half, and the deceased owner's estate owns half. It takes more than joint ownership to have the survivor automatically own all the property. The way that is done is with a survivorship deed. That is a deed that states that the owners are "joint tenants with survivorship" then the last owner to die automatically owns all the property.

We got a good result for our client in a will contest, the decision came out this week. Our client, an elderly widow, was left everything in her husband's will. When she tried to probate his will, his adult children contested. They wanted a jury trial. So, we opted to use a "year's support." proceeding. The court awarded our client over 90% of the property of the estate. We think that the children will see that what is left is not worth enough to justify the expense of a jury... trial, and will not pursue their objections to probating the well for the rest of the estate property. A year's support is a method where a surviving spouse or surviving minor children can receive all or part of the estate, even if they are left out of the will, or will is contested. This award comes before paying creditors. It is a very useful tool in Georgia estate law that can help the surviving spouse or minor children. See more

We are happy to have a win in the Georgia Court of Appeals in a will contest case. The Probate court of Cobb County upheld our client's will and the other side appealed, unsuccessfully. The opinion is pretty short. But it says the right stuff!
