Dear Valued Clients and Business Partners, This is our last chance to stop Senate Bill 442 before it is signed into law. It is being presented to Governor Kemp for signature this week. This bill erodes community associations' authority to adopt, amend, and enforce covenants. SB 442 allows Wall Street Real Estate Investment Companies unfettered access to take over community associations and override a community’s ability to adopt and enforce covenants related to rentals.... SB 442 begins the process to erode the community association housing model as it strips homeowners associations of their ability to create rules for their communities. SB 442 will prohibit some homeowners associations from amending governing documents to restrict rentals of more than thirty days. This bill favors out-of-state for-profit corporations like American Homes4Rent, Progressive Homes, and others who have purchased large inventories of single-family homes in many Georgia communities. In addition, SB 442 is unconstitutional because it violates the private contract between homeowners and their homeowners association. It violates the property rights of individual homeowners in homeowners associations who want to keep the right to pass a rental policy in their community. Please make your voice heard today.
